A mediator has an obligation to make certain the parties have listened to and understand their opponents’s arguments. A mediator must discuss not only the monetary costs and risks associated with trial, but also the emotional and personal commitment required. There is no doubt that some cases need to be tried. We have courthouses, judges and juries for that reason. I frequently serve as an arbitrator for that reason.
